Eviction process by state
The shape of the process is the same almost everywhere. The numbers are not, and the numbers are what get people in trouble.
Eviction is governed by state law, and in some places by city ordinance on top of that.
The stages are broadly the same nationwide — notice, filing, service, response period, judgment,
writ, setout — but the required notice periods, the response window, the forms, the court, and the
executing office all change at the state line.
What is the same almost everywhere
- You cannot remove a tenant without a court order
- Written notice is required before filing
- The case is filed where the property is located
- The response clock runs from service, not filing
- A judgment is not possession — a separate order is needed
- Self-help eviction is illegal, and penalties are often severe
What changes by state
- How much notice you must give, and for which grounds
- How long the tenant has to respond after service
- Which court hears the case and what it's called
- Whether the sheriff, a marshal or a constable executes
- How belongings must be handled at setout
- Whether accepting rent mid-process undoes the case
- Whether an abandonment procedure exists, and its requirements
